This Privacy Policy explains how we collect, use, and safeguard your information when you visit our website or communicate with us through our client portal, MyCase.
We act as the "Controller" of your personal information. Our primary service provider for case management, MyCase (8am) , acts as a "Processor" of your data on our behalf.
2. Information We Collect
We collect personal information to provide legal services. This includes:
Contact Information: Name, address, email, phone number.
Case Information: Details regarding your legal matter, documents you upload, and communications sent via the portal.
Payment Data: Billing information processed through LawPay. (Note: We do not store full credit card numbers; they are tokenized by LawPay).
Technical Data: IP address and cookies for website analytics.
3. How We Use Third-Party Services (MyCase & LawPay)
To manage our practice efficiently, we utilize cloud-based software. Please read this section carefully, as it involves the transfer of your data to third-party sub-processors.
A. Case Management (MyCase)
We use MyCase (operated by 8am, formerly AffiniPay) to store client data, manage documents, and facilitate communication .
Sub-Processors and Your Data:
MyCase uses several third-party sub-processors to operate its platform. By agreeing to this policy, you acknowledge that your information may be processed by:
Amazon Web Services (AWS): Where your data is stored (encrypted at rest).
Twilio: For SMS text message notifications .
Important Disclosure: AI and Large Language Models (LLMs)
MyCase utilizes AI-powered tools (e.g., "MyCase IQ"). MyCase’s privacy policy explicitly states that information submitted to their platform may be shared with "Large Language Model (LLM) provider(s)" to power these features .
What this means: If we use specific AI features within MyCase (such as AI-generated summaries or drafts), the data you provide (your case details) may be sent to third-party AI companies.
Opt-Out: Our Firm will make reasonable efforts to avoid submitting privileged or sensitive data into public AI training models. However, as this functionality is built into the platform, you must notify us in writing immediately if you do not want your case data processed by third-party AI tools.
B. Payment Processing (LawPay)
We use LawPay (an 8am affiliate) to process credit cards and electronic checks. LawPay is PCI-DSS compliant. We do not store your full payment details on our local servers.
4. SMS / Text Messaging (Twilio)
If you opt-in to receive text messages, we use Twilio (integrated with MyCase) to send case updates and appointment reminders .
Opt-Out: You may reply "STOP" to any text message to unsubscribe.
Data Security: SMS is not a fully secure form of communication. Do not send sensitive financial or medical information via text .
5. Data Security
We take security seriously. MyCase employs 256-bit AES encryption for stored data and 128-bit SSL encryption for data in transit, similar to banking standards . However, no method of transmission over the internet is 100% secure.
6. Your Rights
Depending on your jurisdiction (e.g., California CCPA, GDPR), you may have the right to:
Access the personal data we hold about you.
Request deletion of your data.
Opt-out of the "sale" or "sharing" of your data for cross-context behavioral advertising (see Section 7).
7. "Do Not Sell" and Advertising
MyCase’s policy indicates that it shares data with advertising networks and engages in cross-context behavioral advertising (e.g., tracking visitors across different websites to serve ads) .
Our Firm’s Stance: We do not sell your personal data to third parties for monetary value.
Note on DNT Signals: Please be aware that MyCase’s platform currently states it does not respond to "Do Not Track" (DNT) browser signals .
